The Game refuses to go out without a real fight in his sexual assault case with Priscilla Rainey. After being denied for a bid for a new trial in December, a judge has now given the Compton rapper another opportunity to battle it out in court.

As previously reported, Rainey filed a $10 million lawsuit against The Game in August 2015, claiming she was sexually assaulted by the rapper while she was a contestant on his VH1 reality show, She Got Game. She sought the eight-figure sum of money for the “physical, psychological and emotional damages” she claims suffered.

Game decided not to settle out of court, and the matter went to trial. In November, a jury sided with Rainey, and ordered Chuck to pay her $7.1 million.

Game tried to appeal the ruling in December, arguing that the amount was wildly excessive and the MC was not able to defend himself because he was healing from a tooth ailment. His request was denied on a technicality when he didn’t file the motion correctly.

After amending the issue, an Illinois judge has granted the rapper a bid to argue why he should be given a re-trial, according to court documents obtained by Bossip. He will also get to attempt to get the judgment reduced.

Both parties are due back in court at the end of January.

In related news, Game has announced his next LP, Westside Story, will more than likely be his last album.
